A man with several previous public peace disturbance convictions has been told the only person who can help him now is himself.
Fasia Fetuao has been in and out of the court and the Territorial Correctional Facility.
When he appeared before District Court Judge Fiti Sunia, he pleaded guilty to a new charge of PPD.
The defendant said he had been sleeping when his younger brother who was drunk woke him up and challenged him to a fight.
Fetuao pleaded guilty to PPD and he admitted to violating his probation.
Asked if he was drinking, he told the court that he wasn’t.
Prosecutor Christie Dunn cited from the police report, that the defendant was drinking with his brother then they got into an altercation and his sister in law called the police.
Fetuao apologized and said he will try his best not to drink beer anymore but do good for the sake of his children, his wife as well as his entire family.
Judge Sunia pointed out the defendant’s multiple PPD convictions and said nothing seems to be working for the defendant.
The judge noted that the defendant has just completed alcohol counseling with Catholic Social Services.
The court revoked Fetuao’s probation and sentenced him to 90 days at the Territorial Correctional Facility crediting the time he has already spent in confinement.
Speaking to the defendant, Judge Sunia said the next time he appears for an offence, the court will impose 60 or more days of imprisonment.
The judge also said that the court is not going to ask him to stop drinking and it was his choice now.
Representing the defendant was Assistant Public Defender Kate Hannaher and prosecuting the case was Assistant Attorney General Christie Dunn.
