
Governor Pulaali’i Nikolao Pula has signed into law a bill amending the law on pleas of abeyance. The bill states that upon acceptance by the court, a defendant shall be placed on probation for the duration of the plea in abeyance period, as they would be with straight forward probationary sentence.
The court’s probation office shall monitor and enforce this plea in abeyance agreement and provide regular status reports to the court.
The bill also provides that the court shall retain 10% of the non refundable plea in abeyance fee to offset administrative costs of probationary services during the plea in abeyance period.
In signing the bill into law, the Governor said requiring supervised probation for individuals whose pleas are held in abeyance ensures closer oversight, addresses root causes like substance abuse and supports successful re-entry while reducing repeat offenses.
He said the bill also sustains funding for probation services and promotes transparency and accountability, boosting public confidence in how these resources support safer, more rehabilitative outcomes.
