
With reports of a contract termination for a company that was awarded one of the ARPA funded projects for the LBJ Hospital, Tuala-uta Representative Fagaima Larry Sanitoa has followed up on a request he made to LBJ CEO Scott Anesi for copies of performance and payment bonds for all ARPA projects.
Fagaima made his initial request for the performance and payment bonds to the LBJ CEO in an October 31, 2025 letter .
This week he sent an email to Anesi saying that given recent reports that one of the companies is unable to proceed with their project, “I would like to reiterate my request for these documents. ”
He does not mention the company but KHJ News points out that Willis Construction, which was awarded the design build contract for a training facility for the hospital was served a contract termination notice last month.
Fagaima thanked the CEO for his testimony before the House on October 14, 2025 regarding the ARPA funded projects at the LBJ Hospital. He said the detailed presentation was greatly appreciated and very helpful for the legislature’s understanding of LBJ’s ongoing infrastructure improvements.
In his October letter to Anesi, Fagaima said his request was made in the spirt of transparency and partnership to confirm that all procurement requirements under Title 10 are being properly observed , consistent with Anesi’s testimony and the statutory safeguards designed to protect the interests of the American Samoa Government. He cited the requirements for contract bonds in cash or certified check, cashier’s check or other payment form for contract awards under $100,000 and for performance and payment bonds for contracts exceeding $100,000. The contract, performance and payment bonds according to the law shall be in an amount sufficient to protect the government’s interests as determined by the Chief Procurement Officer.
Prior to the Fono recess, Fagaima had also requested LBJ financial reports through the House Public Health Committee. The requested reports are the 2025 LBJ Audit Report, 2026 1st Quarter Accounts Receivable Report and the 2026 1st Quarter Accounts Payable report. He asked if these reports would be made available before the Fono reconvenes on March 2.
