Settlement agreement reached between LBJ Hospital and former CFO

The LBJ Tropical Medical Center is to pay $100,000 to former Chief Financial Officer of LBJ Sefanaia Kaumaitotya as part of a negotiated settlement agreement relating to a complaint that Kaumaitotoya filed with the US Equal Employment Opportunity Commission over the termination of his employment from LBJ Hospital last year.

Under the agreement Kaumaitotoya agrees not to institute a lawsuit against the hospital over his firing.

The agreement spells out that the LBJ Hospital is to issue a press release disclosing a resolution stating that the termination of Kaumaitotoyga on February 14, 2025 was without cause. The hospital will provide a neutral explanation for Kaumaitotoya’s departure from LBJ, acknowledge his contributions to the organization and wish him well in his future.

LBJ is also to provide neutral reference and positive letters of reference for Kaumaitotoya as requested.

Under the agreement the hospital is to expunge from Kaumaitotoya’s employment record any negative reports relating to his departure.

The hospital agrees to provide two hours of web-based or in person Equal Employment Opportunity training for board members, management officials and all Human Resources staff of the hospital to reinforce their understanding of their rights and responsibilities. The training is to focus on race and national origin.

The agreement does not constitute an admission by the LBJ Hospital of any violation of Title VII of the Civil Rights Act which prohibits employment discrimination based on race, color, religion, sex and national origin.

Further the Equal Employment Commission agrees to terminate the investigation which it has begun into Kaumaitotoya’s complaint.

The settlement sum of $100,000 stated in the agreement will not be paid until Kaumaitotoya and the LBJ Hospital have executed and agreed to the terms of a supplemental release of which the EEOC is not a party.

The Hospital Authority Board passed a resolution in July of last year stating that the termination of Kaumaitotoya’s employment was without cause.

The resolution stated that the Board of Directors has reviewed the circumstances of the conclusion of Mr. Kaumaitotoya’s employment with LBJ Tropical Medical Center effective February 14, 2025. The Board has determined that his termination was not the result of any misconduct, violation of policy, breach of duty, or other disciplinary grounds. The LBJ Hospital earlier this week issued a press release confirming that Mr. Kaumaitotoya’s termination on February 14, 2025, was without cause. The release said the matter has since been resolved through the appropriate administrative and legal processes.

Kaumaitotoya was appointed CFO of LBJ in April of 2023.
