
The Samoa Supreme Court has issued a stop order for two missing witnesses who were scheduled to provide evidence in the Falealili No. 1 election petition case.
The witnesses are from the village of Tafatafa, and they were issued warrants of arrest five days ago.
The court was informed that the police were unable to locate the pair.
Malili Nofo Vaega and Faamotuletia Seu cannot leave the country for six months, and the prohibition order could be extended if they are still missing.
Chief Justice Satiu Simativa Perese said the court considered it appropriate to appoint the Attorney General to act as an impartial adviser, to assist the court and when appropriate, make submissions.
“The immediate work may include managing the police effort to locate and bring before the court the couple or other witnesses who might be summoned to assist the court with its inquiry into the allegations of corrupt practices through the payment of money,” said the Chief Justice.
“The court warns that if there is no reasonable excuse for the couple’s non-appearance under the summons, they will be held in contempt of court.”
Chief Justice said the delay caused by the non-appearance of witnesses is unacceptable.
“Persons obstructing the court from discharging its duties will be held accountable.”
The petition was brought by unsuccessful HRPP candidatye Tuiloma Laniselota Lameko against Deputy Prime Minister Toelupe Poumulinuku Onesemo.
The case has been continued to Janaury 19, 2026.
