
While Afamasaga Dr Talifa Talifa Jr. is refusing to step down from the Board of Directors of the American Samoa Medical Center Authority, he has been told that he is no longer a member of the board.
Dr Talifa had cited that his term does not expire until November 20, 2026 and the Governor’s letter terminating his services does not state any statutory cause or identify any procedural basis for his removal.
Also no charges, evidence or notice of a hearing have been provided.
Talifa was informed by the Governor’s Chief Legal Counsel Barry Pfundt in an October 15 letter of the causes for his removal from the Board.
These include:
- Chronic and continuing deficiencies identified by the Centers for Medicare and Medicaid Services specific to the Governing Board of the American Samoa Medical Center Authority
- Receiving payment of sums for Board participation exceeding the statutory limit
- Interference with hiring practices executed by appropriate ASMCA officials/staff
- Interference with procurements executed by appropriate ASMCA officials/staff.
Pfundt told Dr. Talifa, “I strongly suggest you retain legal counsel and discuss the potential impact of bringing legal action in this matter. A case challenging your removal may expose you to liability far beyond the loss of your seat on this board.”
The Chief Legal Counsel continued, “The Governor wished to shield you from the embarrassment of disclosing specifics. That is why these details were left out of the letter removing you from the board. Just as the Governor has a right to remove you, you are well within your rights to challenge that decision.”
The Governor nominated Maaelopa Bob Tuiasosopo to replace Dr Talifa. The Senate did not hold any confirmation hearings for Maaelopa given that Dr Talifa’s term had not expired.
