12 months in jail then return to Samoa

A man convicted of having  sexual relations with a 13 year old relative has been sentenced to 20 months in prison.

Siliva Logovaa also known as Kose came here on a 30 day permit from Samoa in April of this year.  But he didn’t leave when his permit expired and in June the law caught up with him when he was arrested and charged with 9 counts of sexual offences including rape and incest.

The defendant in a plea agreement with the government pled guilty to two counts of sexual abuse first degree for which he was sentenced this morning.

Chief Justice Michael Kruse sentenced Logovaa to 5 years imprisonment for each of the two counts of first degree sexual abuse to be served consecutively.

However the sentence was suspended on condition that he serve 20 months in jail.

After the first 12 months, the defendant will be sent back to Samoa and he cannot re enter for ten years.

Logovaa must register with the Sex Offender Registry and be subject to HIV testing.

It was revealed this morning that the defendant ‘s name on his passport is Siliva Logovaa but when he was picked up by police he said his name was Kose Logovaa.

The Chief Justice said Immigration could not locate his file because there was no one by the name of Kose Logovaa.  The Probation Office ID’d him from his photo.
