
A man who sexually assaulted a 17 year old girl while he was on probation for the same crime, was sentenced today.
Acting Associate Justice Elvis Patea sentenced Michael Sene to 7 years imprisonment for his latest crime of deviate sexual assault.
And for violating his probation from his previous sexual assault offence, which also involved a minor, Sene was sentenced to 5 years imprisonment.
The 28 year old bus driver was initially charged with rape, kidnapping, sodomy and first-degree sexual abuse.
However he pled guilty to an amended charge of deviate sexual assault.
In the most recent case last October, Sene took a 17 year old student of the American Samoa Community College who was a passenger on his bus, to a shack in Nuuuli with the intention of having sex with her.
Th girl fought back but he was too strong and he raped her.
The defendant in his apology asked that he be given another chance saying that he takes care of his mother.
Judge Patea said that the court gave Sene a chance three years ago but here he is back in cort for the same crime.
Patea said the court was pondering if Sene should serve his sentences consecutively.
His final decision was for Sene to serve his sentences concurrently, or together.
After seven years, the parole board can decide if Sene could be releaed back into the community.
Sene must also register as a sex offender when released and undergo HIV testing as required by law.
