Governor Tells ANZ not to Okay ASH Cable Transactions

Governor Lolo Moliga is getting tough with the owners of BlueSky, Amper Sa.

Last Friday, the governor informed ANZ Bank by letter that any transaction relating to the American Samoa Hawaii Cable accounts with ANZ by anyone other than the authorized signor, Mr. Adolfo Montenegro, should not be allowed.

Amper is trying to sell BlueSky to Fijian company, Amalgamated Telecom Holdings Inc. and has accepted a $79.1 million offer from ATH.

The sale has to go through regulatory approval including with the Federal Communications Commission, and depending on who you talk to, it’s either a process that will take several more months or it’s  just a matter of time before the sale is completed.

In the last month, Amper has fired Montenegro who was president and CEO of BlueSky.

ASG  owns a third of the management company for the undersea fiber optic cable that connects the two Samoa and Hawaii, American Samoa Hawaii Cable.

Montenegro is also CEO of that company.

And Governor Lolo has objected to Amper removing Montenegro as CEO of ASH Cable.

Now in his latest letter of October 14 to ANZ Bank, the governor tells the bank that Amper Sa, the parent company of Elandia Technologies Inc, the other member of ASH Cable, has removed Montenegro from ASH.

And further, ASG has been informed that attempts have been made to pay certain invoices from AS Cable’s ANZ accounts without Montenegro’s approval or signature.

The governor asserts that ASG did not approve the removal of Montenegro.

Nor did ASG approve the appointment of another individual to replace Montenegro as the aphorized signatory for ASH Cable.

He tells ANZ Bank, “Until you receive written communication from me or an official resolution of ASH Cable authorizing a replacement for Mr. Montenegro, please deny any and all requests to draw, transfer, or otherwise take out funds from ASH Cable accounts with ANZ.”

And he added, “ASH Cable will hold ANZ responsible for any losses resulting from your failure to follow this request.”

The governor’s letter to the bank was copied to Tilafau Douglas Creevey, whom Amper named as Acting CEO of BlueSky.
