Chief Justice Expects Proof of Service for Supboena

Chief Justice Michael Kruse is giving the Attorney General’s office until November 10th to provide evidence that they did serve the Chief Immigration Officer Tamasa Dennis Lutu with a subpoena for a July 2015 hearing which Tamasa failed to attend.

During sentencing of Tamasa on Monday, he chief Justice directed comments to  Deputy Attorney General  Mitzie Jessop Ta’ase telling her if the government doesn’t take action the court will move to  have another trial against the Chief Immigration Officer.

The immigration chief was sentenced Monday to 14 days in jail for contempt of court for testimony that the court found less than truthful.

Tamasa was subpoenaed for a July 2015 hearing to explain why a convicted sex offender banned from the territory was able to re-enter.

The Immigration chief maintained that he was not given the date for the new hearing.

On Monday before he was sentenced Tamasa said he blamed himself for failing to appear at the hearing.

Chief Justice Kruse said  the immigration chief’s testimony contradicts his initial claims whereby he blamed the AG’s office for not letting him know of a subpoena for the July court heating.

The immigration chief was off island attending a family reunion.

He told the court at a previous haring that had he known of the date for the hearing he would not have made plans to travel off island.
