Plea Deal Rejected for Man Who Forced Wife to Have Sex

Chief Justice Michael Kruse today rejected a plea bargain for Aska Faleali’i Laulu who faces multiple charges and set a date for his trial.

The defendant is charged with 6 counts of private peace disturbance, 2 counts of assault in the 3rd degree, rape, restraining order and sexual abuse.

Laulu, represented by Assistant Public Defender Mike White had already signed an agreement with the government, represented by Assistant Attorney General Gerard Murphy, where he pleaded guilty to 3rd degree assault, restraining order and sexual abuse.

The court rejected the agreement on grounds which Chief Justice Michael Kruse explained were a domestic violence matter involving a common law marital issue.

Therefore the conditions of the plea agreement are not in compliance with domestic violence statues.

The government’s case has it that on February 19th the defendant arrived home intoxicated and forced the victim to have sex without her consent.

The victim allegedly yelled out to her mom who came to her rescue and started pulling off the defendant.

Court filings say the defendant pulled the mom ‘s hair and pinched her stomach.

The wife received injuries when the defendant pinched her in the stomach, and bit her hands while she was trying to pull away from him.

Chief Justice Kruse and associate judges Muasau and Fa’amausili scheduled Laulu’s jury trial for August 8th.
