Parties in dispute over Fagatogo Square make progress

Acting Associate Elvis Patea today told the parties in the dispute over ownership of the Tedi of Samoa Building and Fagatogo Square not to get the court involved in their out of court matters.

David Vargas, attorney for original owners of the property, Bill and Apoua Tedrick, had mooted that all rents collected from current tenants in the buildings in dispute be deposited with the court until the matter has been settled.

This was not objected to by counsel for the plaintiff, Avapui II.

But Acting Associate Justice Patea said that he will not entertain such a notion.

“Don’t pull us into this. Dont involve the Court, we are already overwhelmed with other things,” he said.

Patea said the case was called today “to show cause” and not to look at anything else. Avapui petitioned the court for a temporary restraining order to stop Archie Leoso and Attorney David Vargas, acting on behalf of the Tedrecks, from collecting the rents from tenants of Tedi of Samoa , and also from taking foreclosure action against Avapui II.

The Tedrecks contend that Avapui II has defaulted on payments for the property.

Attorney for the plaintiffs told the court that the parties were making progress in their deliberations, “but we’re not quite there yet”.

He then asked for a 7 day continuance to delve into remaining details on the matter.

Acting Associate Justice Patea granted a 10 day continuance and called the parties back in court next Wednesday Sept 5th for a hearing on their grievances.
