Court Finds No Evidence in DUI Case

The District Court has found no evidence to create suspicion for careless driving against Isalei Iuli who is being charged with driving under the influence.

The court has therefore accepted the defendant’s motion through her counsel, Gwendolyn Tauiliili Langkilde to suppress evidence.

A police officer testifying for the prosecution said that on May 17th, they were on patrol in the Malaeimi area and were in front of the Sunrise sewing shop when Iuli’s car passed them.

Police officer Aiono saw the defendant’s car veering to the east bound lane and then to the west bound lane while speeding.

The cops decided to pursue the defendant’s vehicle and pulled her car over in front of the Lucky Dragon restaurant.

The cops detected that Mrs. Iuli was under the influence of alcohol.

The defendant told the police that she was at a party at the Tradewinds earlier where she had 3 glasses of wine.

Police said that the defendant was explained her rights and was given gave the standard sobriety test.

During cross examination, Mrs Iuli’s lawyer asked the witness if police were using a speed radar when they decided to pull over her vehicle.

The police officer said they did not.

The defense lawyer also pointed out that her client did not sign a consent form for the sobriety test and there was no other witness to sign the consent form as required.

Mrs Iuli’s case will be called again on August 4th.
