Yesterday’s probable cause hearing for Mel Katrina Wells ended with a dismissal of charges against the defendant.
Wells had picked up a package from the Pago Pago Post Office last week in which 3 pounds of methamphetamine were allegedly found.
She was charged with possession with intent to deliver and possession of controlled substances crystal methamphetamine. Three plastic baggies containing 3 pounds of meth were hidden inside the empty shell of a Central Processing unit of a computer.
District Court Judge Fiti Sunia dismissed the charges for lack of probable cause.
He said that possession has two elements, ‘dominion and control’, and knowledge.
He said although the defendant had dominion and control because she had picked up the package in which the drugs were found, the government failed to prove probable cause as to her knowledge that the package contained drugs.
He therefore dismissed the case without prejudice.
