The High Court has taken under advisement several motions filed by the legal counsels of four men charged in the drive-by shooting of the police substation in Leone in 2014.

The four defendants, Manu Lefatia, Sinapati Tu’ufa’anatu, Tuliese Taliu and Mosegi Solia, appeared before Judge Elvis Patea, assisted by Associate judges Mamea Sala Jr and Tunupopo Alalafaga.

Private Attorney Sharron Rancourt, representing Leafatia said she wants to file a motion to compel discovery or even for dismissal of the charges against her client.

She said new reports with the prosecution amounting to hundreds of pages have not been turned over by the government.

In another development, one of the defense attorneys, Assistant Public Defender, Karen Shelly has filed a motion to continue the case as she will be leaving the territory for good and her replacement is due to arrive in early January.

During the hearing this morning, one of the defendants, Mosegi Solia, raised his hand trying to get Judge Patea’s attention while the judge was speaking.

The judge gave him the opportunity to speak but his attorney Assistant Public defender Michael White interjected and stopped Solia from saying anything further.

Judge Patea then ordered the defendant to consult with his laywer.

Assistant Attorney General Gerard Murphy, who’s prosecuting the case also informed the court they need to request the Commisioner of Public Safety to view the video clip of the alleged incident.

Judge Patea has continued to Friday, the hearing on the Leone substation shooting case.
