A man whom Chief Justice Michael Kruse calls a “career criminal” was sentenced this morning to 5 years imprisonment  for his latest crime.

Joe Togitogi’s sentence was for second degree assault stemming from an incident in front of the Hong Kong restaurant in May of last year in which he punched a man who accused him of stealing a TV set,.

At the time, Togitogi was on probation after serving 20 months in jail for an April 2014 assault conviction.

The court revoked his probation and has sent him back to jail for five yeats,

The victim’s mother said from the stand this morning that her son is currently serving in the military and has forgiven Togitogi for what he did to him.

She said that no crime should go unpunished and hoped the defendant is remorseful.

She prays he will change and find a new way of life.

The mother  thanked the court for giving her son peace and justice ,

Assistant Attorney General Tyler Genzal asked for the maximum sentence for Togitogi, drawing the court’s attention to his history of criminal activities and violations.

The prosecutor said as with other previous violations, the defendant did not feel any responsibility for his offences. ‘

When giving his apology, Togitogi said he was particularly sorry he’s not made use of the chance given him by the court to be a good citizen.

He said his anger  got the better of him and he succumbed to the work of the devil.

Togitogi apologized to the court as well as to the victim. He claimed he has learnt from his mistake and he would not let this happen again.

Chief Justice Kruse said that Togitogi can start serving his 5 years when he’s completed the jail  time he’s currently serving.
